Following the AGM, the Executive Committee decided that if we were to make progress with Infraquinta generally and respond to specific questions about such areas as the tennis courts we needed more information. SPOA has few documents relating to Salinas, most information that we have has been passed on verbally.
We have asked Ana da Palma Almeida to research this for us. She has reviewed documents and held consultations with officials from the Land Registry and Loulé Camara.
Summary of the findings so far.
Only three small areas of land were ceded to the Camara by Raymond van Gelder namely the ETAR (old sewage area) 170m2, the Parque Infantil next to Villa 13, 740m2 and zona verde complemental (Which we believe forms the route for sewage from Salinas Clube)310m2. In addition there is a further 21,262m2 allocated to roads, paths and parking. Taken together these are the only truly public areas in Salinas.
A further 4 areas are identified as Area de Equipamento e zonas verdes integradas (Plots 76, 77, 78 and 79. These areas 76 (Where the original cisterna was located) and 78 and 79 (including the tennis courts) are generally thought of as community areas though they are privately owned. Lots 78 and 79 were bought by Yentl Holdings BVand Mrs Gertrudis Nefkens in 2006. Documents for these two areas are described as for “construção urbana” but this description includes club house, reception, pool etc . In this case it does not allow the construction of villas or apartments.
We originally thought that we should have an amendment attached to the development plan to safeguard our position but we have been assured by the Land Registry that the documents are in order and that no amendment is necessary.
The Salinas Plans and Allotment Permit and Land Registry record of plots is all in order and meets the requirements of the law as set out at the time. (Decree-Law 289/73)
The law relating to community areas has subsequently changed and nowadays all of the equipment areas and green zones would either be made over to the Council or to an Association to manage them on behalf of all owners. They could not remain in private ownership.
We are now seeking written confirmation of what we have been told so far and are asking what concessions or contract can be granted, to Salinas owners through the Association, for managing the community areas
