Thank you for your reply to our earlier letter.
There are some points we would like to clarify and some further questions we would like to ask.
1. The letter was sent on behalf of the Owners Association Executive Committee which represents all Salinas owners. The Executive Committee comprises Mr Ben Heisterkamp, Mrs Sara Caetano and Mr Chris Bateman with Ms Celia Barros as a co-opted member. For further clarification please note that these members are the only persons authorised to negotiate with Infraquinta.
2. We, and all the owners, fully appreciate the extra work that Infraquinta has already done to improve the standard of water and drainage in Quinta das Salinas.
3. We know that owners are not contributing to road rebuilding costs, nevertheless you will understand from our meetings that this is the most important issue for them. Our letter reflected concern that the road programme has been delayed. At one time you told us that you hoped to be able to complete all the work in a single phase. We were also given October/November as a start date. We are now nearing the end of March with only approximately 300metres of road having been resurfaced and the roads in the rest of Salinas deteriorating rapidly; but we are pleased to see your confirmation that Phase 2 has been “adjudicated and will start within a few days”.
4. From our meetings we had understood that Infraquinta was to take over total responsibility for refuse collection and that you, and not City Hall, would be providing both the moloks and the recycling bins and that would be the basis for starting to charge monthly fees. We were surprised to discover that Loule Camara had done the work and that they were also continuing the collection, because you had already started debiting fees.
5. We also appreciate that road cleaning is difficult in the part of Salinas alongside plots 62, 63 and 64 because of the sand and debris running down the hill from the building site but believe that the rest of Salinas could be swept effectively. Originally you told us of drainage problems on 13 plots rather than the 17 you mention in your last letter. We contacted the original 13 owners but you must appreciate that we have no authority to force them to rectify problems, we can only ask for their co-operation. We will contact them again; but we believe an “official” letter from yourself is more likely to be effective
Since we first met with you the roads have deteriorated rapidly and their resurfacing is a priority for all owners. Assuming that Phase 2 is ready to go ahead and is completed quickly that still leaves more than 50% of owners with plots facing Phase 3 roads.
The comments in our previous letter were based on your letter of 2nd June 2008; in particular we refer to paragraph 6 when referring to fees it says “ The above rates include : repair and maintenance of the roads/pavements, maintenance of the green zones, sewage charges and maintenance and rubbish collection."
Finally we reiterate that we appreciate the work that Infraquinta has already done but we feel that the issue of refuse fees and Phases 2 and 3 roads need to be resolved. In particular we would be pleased to get a firm commitment to dates for the commencement of work .
It would be helpful to us if we could meet in the near future

Obrigado pela sua resposta à nossa anterior carta.
De seguida alguns pontos que gostaríamos de clarificar e algumas questões que gostaríamos de colocar.
1. A carta foi enviada em nome da Direcção da Associação de Proprietários da Quintas das Salinas (mais conhecida pelo seu acrónimo Inglês SPOA), a qual representa os proprietários da mencionada urbanização. A Direcção é constituída pelo Sr. Ben Heisterkamp, Dra. Sara Caetano e Sr. Chris Bateman, sendo a D. Célia Barros um membro cooperante. Mais esclarecemos que estas pessoas são as únicas autorizadas a representar a SPOA junto da Infraquinta.
2. Nós, e todos os proprietários, obviamente valorizamos e agradecemos o trabalho já levado a cabo pela Infraquinta com vista a melhorar o fornecimento de água e os esgotos na Quinta das Salinas.
3. Deve entender que a repavimentação das estradas é o assunto mais importante para todos os proprietários. A nossa carta reflectia a preocupação sentida ao verificar o atraso no programa de reparação das estradas. A dada altura o Eng. Luís Inês disse-nos que esperava completar tal programa numa única fase. Foi-nos igualmente comunicado como data de início Outubro/Novembro. Estamos agora no final de Março e apenas aproximadamente 300 metros de estrada foram repavimentados e o resto encontra-se em avançado estado de deterioração; mas estamos satisfeitos com a confirmação de que a “Fase 2” foi adjudicada e será iniciada dentro de dias.
4. Tínhamos entendido aquando das nossas reuniões que a Infraquinta ficaria totalmente responsável pela recolha do lixo e que seria esta entidade, e não a Câmara, quem colocaria os moloks e os depósitos para recicláveis e que isto seria o fundamento para iniciar a cobrança dos custos mensais. Ficámos, pois, surpreendidos ao saber que fora a Câmara de Loulé a efectuar tais trabalhos e que a mesma continuaria a recolher o lixo, uma vez que a Infraquinta já começara a debitar tais custos.
5. Compreendemos que a limpeza das estradas é difícil junto aos lotes 62, 63 e 64 devido à areia e detritos vindos da obra em construção, mas julgamos que o resto da urbanização pode ser eficazmente limpa. Originalmente a Infraquinta alertou-nos para problemas existentes em 13 lotes e não em 17 lotes como se menciona na V/ última carta. Contactámos os proprietários dos 13 lotes originalmente mencionados mas deve entender que a SPOA não tem qualquer autoridade para forçar os mesmos a rectificar os problemas existentes, apenas podemos pedir a respectiva colaboração. Iremos contactar os proprietários de novo, mas julgarmos que uma carta “oficial” da Infraquinta tem muito maior probabilidade de produzir efeitos.
6. Desde o início das nossas reuniões as estradas têm vindo a deteriorar-se rapidamente e a sua repavimentação é a principal prioridade para todos os proprietários. Mesmo que a “Fase 2” tenha início em breve e seja rapidamente terminada, ainda assim mais de 50% dos lotes está incluída na “Fase 3”. Agradecemos, pois, que nos informe quando começarão as Fases 2 e 3.
O O conteúdo da nossa anterior carta foi baseado na carta da Infraquinta de 2.6.2008 (cf. cópia em anexo) e nas nossas reuniões anteriores consigo, particularmente o paragrafo 6 que diz:

Translation: Infraquinta reply 20th March 2009
This is a verbatim translation of the original letter. Some sections will need further clarification since they conflict with information we have been given earlier. In particular we will attempt to clarify the issue of refuse collection charges
Please note that in paragraph 7 “pavements” refers to the roads. “Moloks” in paragraph 9 are new in the ground bins. Paragraph 16 refers to enclosed photographs but these are not included because the copies are not of suitable quality to be reproduced.
Essential points to note are:

The letter
Dear Sirs,
1.Infraquinta had in 2008 a great investment in order to provide water to QSalinas, it has installed a new 50.000 liters deposit and it built a new pumping station, this work through the exclusive use of its own resources/means.
2.Later on Infraquinta had to replace all QSalinas water distribution system metallic accessories, this is, all valves and curves of the water distribution net.
3.25 road crosses were remade, because they were previously made with metallic tubes and were in very bad shape.
4.It was necessary to repair several net damages since the system could not support the works pressure.
5.Finally Infraquinta made the water meters compartments and in some cases the respective covers/doors whenever they did not exist (majority) or were in very bad shape.
6.Following these works, Infraquinta started the water supply and respective charge, neither charging the sewage tax nor the urban solid wastes tax.
7.In January Infraquinta started QSalinas pavements. The works were divided in 3 phases, since it did not had the resources to make all the pavement at once, because the roads were in a awful condition. The 1st phase is concluded and the 2nd one was adjudicated and the works will start during the next few days.
8.In January Infraquinta started to collect the sewage tax and the urban solid wastes tax, the later assured by Loulé City Hall.
9.In February 3 Moloks were installed by Loulé City Hall and Infraquinta will install progressively underneath recyclable containers, thus substituting the existing ones at the QSalinas entrance. These works will be performed along the time and according to Infraquinta financial possibilities.
10.It is not possible to collect the rubbish door to door since most of the houses do not have rubbish compartments and the sidewalks are much too small to allow the containers to be placed on the street and wait for due collection, anyway such possibility was never mentioned.
11.We consider strange that the letter’s author did not realize the Moloks installation, since the same had the previous agreement of the property owners that claimed to be SPOA Board
12.Infraquinta never said what is stated on point 3 – 2nd phase of the roads pavement was never postponed.
13.There was no contact during March and thus I find strange the statement of paragraph 5.
14.It is also strange that the letter’s author did not notice the Moloks installation, which contradicts point 6 statements.
15.Infraquinta has tried to keep the streets clean, but due to their bad conditions. Due to several ongoing constructions, this placed earth, sand and several wastes in the streets whenever it rains. Due to the fact that plots 77, 38, 39, 40, 41, 28, 29, 44, 33, 49, 67, 57, 60, 59, 55, 54 and 74, which drain irrigation waters, pool waters and rain waters into the streets, despite all area being served by a rain waters system. It is true it has not been possible to keep the streets as clean as desirable. Of such difficulties we informed the property owners that we have met.
16.Infraquinta has asked for SPOA cooperation in order to make such property owners (referred plots) sensible to the need to proceed to the connection of the respective plots to the rain waters system before the new pavement was placed. Since the rain waters system is located on the centre of the roads it will be necessary to cut the pavement, damaging the same right after its repair. (Enclosed photos of the problematic plots and we await you to inform us about this problem solution).
17.Once again we find strange that point 7 refers to door to door collection, because aside the fact the urbanization is not prepared, as already mentioned, the zones that have this kind of service, on a regular basis, pay a separate charge for such effect.
18.Infraquinta charges to the owners water, sewage and urban solid wastes, all of these services are available and have been provided, it is true that the solid wastes collection is still performed by the City Hall. Nothing is charged for the roads maintenance, thus we find strange point 8.
19.Once again we find strange what is referred on point 9, since the direct debit is only possible according to a previous owner’s authorization, which can be cancelled at any moment.
20.It is true that the roads are in very bad conditions and they are being repaired. It is unfair to mention that the water system is in bad conditions, it was repaired by us. Equally we have detected problems in the sewage (rain waters and domestic) system which we have been correcting, thus I disagree with point 11.
I consider that the letter, aside the fact of not correspond to the true, is profoundly unfair to the committed work Infraquinta and its workers have been performing to provide the best possible services to Salinas residents.
From Quinta do Lago, Infraquinta has received infrastructures in very good shape, which has been trying to keep. In QSalinas it has been necessary to make almost everything new, unfortunately it will take some time and a lot of work and investment to recover what has been damaged e remake what was wrongly made.

Infraquinta and Loule Camara
We are still waiting for a response fom Infraquinta and the Camara.
The letter and its English translation:
Exmo. Senhor Presidente da Câmara Municipal de Loulé
Exmo. Senhor Presidente do Conselho de Administração da Infraquinta
REF: Quinta das Salinas, freguesia de Almancil, concelho de Loulé
Escrevemos na qualidade de membros da Direcção da SPOA – Associação de Proprietários da Quinta das Salinas, nos termos e para os efeitos seguintes:
1. Após inúmeros contactos no decurso do último ano e sobretudo após as reuniões tidas em Setembro/Outubro de 2008 com a Infraquinta, informámos os proprietários da Quinta das Salinas acerca das BOAS NOTÍCIAS:
A Infraquinta iria instalar modernos contentores (similares aos existentes na Quinta do Lago e Vale do Lobo) para depósito de papel, vidro, plásticos, etc.
As estradas seriam arranjadas, com as obras a iniciarem-se em Novembro/Dezembro de 2008.
A Infraquinta iria providenciar pela limpeza e manutenção das estradas e zonas comuns, MUITO EM BREVE.
A Infraquinta iria iniciar a colecta porta-a-porta do lixo (como acontece na Quinta do Lago e Vale do Lobo) MUITO EM BREVE.
2. Obviamente informámos todos os proprietários dos resultados das nossas reuniões e estávamos efectivamente satisfeitos e orgulhosos com o progresso obtido no decurso das reuniões com a Infraquinta.
3. Em Dezembro último, tivemos de informar os proprietários de que existiam “pequenos problemas” relativos à reparação das estradas e que afinal a Infraquinta iria operar em 3 fases. Não existiam motivos para preocupação uma vez que “os contratos com os empreiteiros já tinham sido assinados”, foi-nos dito. A Fase 1 junto aos apartamentos já estava terminada. A Fase 2 começaria em Janeiro e a Fase 3 pouco tempo depois.
4. No final de Janeiro informámos os proprietários de que a Fase 2 tinha sido adiada até à segunda quinzena de Fevereiro e que a Fase 3 não tinha ainda data de início.
5. Agora, já em Março, nada aconteceu e nos últimos contactos com a Infraquinta não nos foi possível obter QUALQUER COMPROMISSO acerca de quando os trabalhos na estrada prosseguirão e serão concluídos.
6. Não foram instalados quaisquer modernos contentores (separação dos lixos) e as estradas e zonas comuns NÃO são limpas/mantidas há mais de 5 meses (a SPOA cancelou o contrato de manutenção que tinha com uma firma privada que utilizava para este efeito, uma vez que a Infraquinta iria tomar conta da urbanização em Novembro).
7. A colecta de lixo porta-a-porta não está a ser feita pela Infraquinta e temos de levar o lixo a cada um dos locais onde se situam (e situavam antes) os contentores, e de onde a Câmara continua a recolher o lixo, tal como tem feito nos últimos 20 anos.
8. Para além do exposto, a Infraquinta iniciou a cobrança aos proprietários (através de débito directo, nos casos em que os proprietários tinham tal modalidade na cobrança do consumo de água) de serviços que NÃO foram, nem são, pela mesma prestados e sem que o estado, perfeitamente inaceitável, das estradas se tenha alterado.
9. Consideramos que esta atitude é completamente desrespeitosa, senão mesmo ilegal, a de retirar quantias das contas dos proprietários quando o único serviço prestado é a colecta de lixo, e por parte da Câmara de Loulé, nem sequer pela Infraquinta.
10. É por demais evidente, que a Direcção da SPOA tem, ao longo deste processo, perdido credibilidade junto dos seus membros e dos restantes proprietários em face da transmissão contínua de promessas, por parte da Infraquinta, que nunca se concretizam e comunicadas por nós aos proprietários com a máxima boa fé.
11. Finalmente, gostaríamos de mencionar (uma vez mais) que o estado deplorável do sistema de esgotos e de águas e das estradas, ao longo dos tempos, foi inteiramente devido à atitude complacente da Câmara para com o Sr. van Gelder, a qual lhe tem permitido ignorar as suas obrigações como urbanizador e não garantir o cumprimentos das mesmas. A SPOA inúmeras vezes, sem qualquer sucesso, contactou anteriormente a Câmara no sentido da mesma forçar o Sr. van Gelder a cumprir os seus deveres como urbanizador.

After our various discussions last year and especially the meetings we had in September/October 2008, we informed the property owners of Salinas of the good news.
Infraquinta was going to install new modern waste bins (similar to the ones they have at Quinta do Lago and Vale do Lobo) for the deposit of paper, glass, plastics etc.
The roads and pavements in Salinas were going to be repaired and resurfaced by Infraquinta, starting November/December 2008.
Infraquinta was going to arrange road cleaning/sweeping “very soon”.
Infraquinta would start to arrange door-to-door rubbish collection (same as at Quinta and Vale do Lobo) “very soon”.
Obviously we happily informed all property owners of the results of our meetings and we were quite happy and proud with the progress, as mentioned above, we had made during our discussions with you.
In December last year, we had to inform the property owners that there were some “slight problems” with the road repair/resurface and that Infraquinta was now going to do the work in 3 phases. There was no need to worry “the contracts with the road builders have already been signed”, we were told.
Phase 1 was behind the apartments and had already been completed. Phase 2 would start in January and phase 3 “soon after”.
At the end of January we had to inform the property owners that phase 2 had been delayed till the 2nd part of February and phase 3 unknown.
Now early March, nothing has happened and during our last contacts with Infraquinta we could not get any commitment whatsoever, when work to the roads will be continued.
No new modern waste bins have been installed and roads have now not be cleaned/swept for 5 months (the SPOA cancelled the contract with a private company that used to do this work, because Infraquinta would start to take over in November)
Door-to-door rubbish collection is not being done by Infraquinta and we have to deliver our rubbish to the same collection points as in the past, where Loule Council is collecting the rubbish as they have been doing for the last 20 years.
In the meantime Infraquinta has started to collect (via direct debits) money from the property owners for work and services not being provided by Infraquinta.
In this respect we feel that it is disrespectful, if not illegal, to withdraw money from the accounts of property owners, if the only service provided is rubbish collection and made by Loule Council, not even Infraquinta.
It may be clear to you, that the Board of Salinas Property Owners Association (SPOA) have lost any credibility with their members and other property owners, because we keep feeding them with promises, based on information given by Infraquinta and submitted by us in good faith.
We finally, would like to mention (once again) that the deplorable state of the sewage system, water supply and roads was and is entirely due to the easygoing attitude of the Council (Camara), allowing Mr. Van Gelder to completely ignore the Alvara and releasing the guarantee he once had given to the Camara. The property owners/SPOA have informed Loule Council plenty of times in the past, that they had to force Mr. van Gelder to fulfil the duties he had under the Alvara, without any success.
We believe that the SPOA (on behalf of the property owners) is entitled to a meeting with you and the responsible Council Officers at short notice in order to discuss and agree a quick and reliable time schedule for the near future.

REF: Quinta das Salinas, freguesia de Almancil, concelho de Loulé
Escrevemos na qualidade de membros da Direcção da SPOA – Associação de Proprietários da Quinta das Salinas, nos termos e para os efeitos seguintes:
1. Após inúmeros contactos no decurso do último ano e sobretudo após as reuniões tidas em Setembro/Outubro de 2008 com a Infraquinta, informámos os proprietários da Quinta das Salinas acerca das BOAS NOTÍCIAS:
A Infraquinta iria instalar modernos contentores (similares aos existentes na Quinta do Lago e Vale do Lobo) para depósito de papel, vidro, plásticos, etc.
As estradas seriam arranjadas, com as obras a iniciarem-se em Novembro/Dezembro de 2008.
A Infraquinta iria providenciar pela limpeza e manutenção das estradas e zonas comuns, MUITO EM BREVE.
A Infraquinta iria iniciar a colecta porta-a-porta do lixo (como acontece na Quinta do Lago e Vale do Lobo) MUITO EM BREVE.
2. Obviamente informámos todos os proprietários dos resultados das nossas reuniões e estávamos efectivamente satisfeitos e orgulhosos com o progresso obtido no decurso das reuniões com a Infraquinta.
3. Em Dezembro último, tivemos de informar os proprietários de que existiam “pequenos problemas” relativos à reparação das estradas e que afinal a Infraquinta iria operar em 3 fases. Não existiam motivos para preocupação uma vez que “os contratos com os empreiteiros já tinham sido assinados”, foi-nos dito. A Fase 1 junto aos apartamentos já estava terminada. A Fase 2 começaria em Janeiro e a Fase 3 pouco tempo depois.
4. No final de Janeiro informámos os proprietários de que a Fase 2 tinha sido adiada até à segunda quinzena de Fevereiro e que a Fase 3 não tinha ainda data de início.
5. Agora, já em Março, nada aconteceu e nos últimos contactos com a Infraquinta não nos foi possível obter QUALQUER COMPROMISSO acerca de quando os trabalhos na estrada prosseguirão e serão concluídos.
6. Não foram instalados quaisquer modernos contentores (separação dos lixos) e as estradas e zonas comuns NÃO são limpas/mantidas há mais de 5 meses (a SPOA cancelou o contrato de manutenção que tinha com uma firma privada que utilizava para este efeito, uma vez que a Infraquinta iria tomar conta da urbanização em Novembro).
7. A colecta de lixo porta-a-porta não está a ser feita pela Infraquinta e temos de levar o lixo a cada um dos locais onde se situam (e situavam antes) os contentores, e de onde a Câmara continua a recolher o lixo, tal como tem feito nos últimos 20 anos.
8. Para além do exposto, a Infraquinta iniciou a cobrança aos proprietários (através de débito directo, nos casos em que os proprietários tinham tal modalidade na cobrança do consumo de água) de serviços que NÃO foram, nem são, pela mesma prestados e sem que o estado, perfeitamente inaceitável, das estradas se tenha alterado.
9. Consideramos que esta atitude é completamente desrespeitosa, senão mesmo ilegal, a de retirar quantias das contas dos proprietários quando o único serviço prestado é a colecta de lixo, e por parte da Câmara de Loulé, nem sequer pela Infraquinta.
10. É por demais evidente, que a Direcção da SPOA tem, ao longo deste processo, perdido credibilidade junto dos seus membros e dos restantes proprietários em face da transmissão contínua de promessas, por parte da Infraquinta, que nunca se concretizam e comunicadas por nós aos proprietários com a máxima boa fé.
11. Finalmente, gostaríamos de mencionar (uma vez mais) que o estado deplorável do sistema de esgotos e de águas e das estradas, ao longo dos tempos, foi inteiramente devido à atitude complacente da Câmara para com o Sr. van Gelder, a qual lhe tem permitido ignorar as suas obrigações como urbanizador e não garantir o cumprimentos das mesmas. A SPOA inúmeras vezes, sem qualquer sucesso, contactou anteriormente a Câmara no sentido da mesma forçar o Sr. van Gelder a cumprir os seus deveres como urbanizador.

Although we have no reason to believe that work on the roads will not go ahead, we are concerned that Infraquinta is allowing the schedule to slip.
Because of this we are requesting a formal meeting between ourselves, Infraquinta and Loule Camara (As major shareholders in Infraquinta)
